I - APPLICATION
The purpose of these general conditions of sale is to govern the relationship between :
- the company Greenzy SRL, whose registered office is located at 11 rue du Halage, 1460 Ittre, Belgium. Registered under company number 0748.643.624, hereinafter referred to as the Seller;
- the Internet user who has adhered to our general conditions by becoming a Greenzy customer, hereinafter referred to as the Customer.
These conditions are applicable to all purchases made on the Seller's website. The act of placing an order implies the Customer's full and unreserved acceptance of these general terms and conditions of sale.
II - PRODUCTS
Greenzy presents the Products for sale and their characteristics on the Site. The Customer has the possibility of knowing, before the final order is taken, the essential characteristics of the Products he/she wishes to buy.
The offers in stock presented by the Greenzy company are only valid while stocks last.
The photos representing the Products are for information purposes only. These photos, as well as the texts illustrating the Products, are not part of the contractual field.
III - ORDERING PROCEDURES
Orders are placed exclusively on the internet via the merchant site www.greenzy.eu.
Any order will result in the receipt on the email address used to place the order of an order confirmation message summarising the order itself, as well as the main provisions of these general terms and conditions of sale, in particular relating to delivery.
Only this confirmation guarantees the availability of your order.
IV - PRICES
The prices are displayed in euros including all taxes, including Belgian VAT, and are only valid on the date the Order is validated by the Customer. Greenzy reserves the right to modify them, without prior notice, at any time, it being understood that the Products will be invoiced on the basis of the prices in force at the time the Order or the Pre-order is recorded.
For deliveries to countries outside the EU, VAT will be deducted when the Customer's order is validated. In the case of such shipments, import duties and taxes may apply and will be collected at the time of delivery to the shipping address.
In the event of a change in the VAT rate, the price will be automatically modified without any prior notice other than the date on which the new rate becomes payable.
Orders are payable immediately via the merchant site, and therefore no discount is provided.
The price to be paid is the one indicated on the site at the time of purchase, increased if necessary by the transport costs applicable according to the destination. It will be recapitulated at the time of validation of the order.
The Seller only undertakes to honour the order at the time it is paid for.
V - METHODS OF PAYMENT
Payment for products is made via WooCommerce Payments to ensure a high level of security. The Seller never has access to confidential payment information. Only WooCommerce Payments has access to confidential payment information.
VI - DELIVERY
VI.I Place of delivery
Delivery shall be made to the delivery address indicated by the Customer, it being specified that this must be the Customer's home address or that of any other natural person of his/her choice, if this is clearly specified at the time of the Order. At the time of ordering, the Customer must fill in his/her delivery address and must indicate a telephone number and an e-mail address where the carrier can be contacted. The Customer may choose to have the goods delivered to an address other than the billing address.
When registering the Customer's personal details, the Customer must ensure that the compulsory data provided is accurate and complete. In the event of an error in the wording of the recipient's details, Greenzy cannot be held responsible for the impossibility of delivering the Product(s).
The amount of the delivery costs is indicated at the time of purchase and is subject to the Customer's approval during the validation of his/her order before proceeding with payment.
VI.II Delivery times
Delivery times are indicated at the time of the Order. These are indicative times, expressed in working days, and correspond to the average times for processing the order and its delivery.
The delivery date for pre-orders is approximate, a more precise date will be provided to the Customer approximately one month before delivery. Greenzy declines all responsibility in the event of a delay in the delivery of pre-orders.
Greenzy cannot be held responsible for the consequences of a delay in delivery that is not of its making or that is due to an act of force majeure. In the event of force majeure, preventing delivery partially or totally, this period will be extended by the proven duration of the force majeure. It is recalled that the following are considered as cases of force majeure: strikes, blockages of road, rail or air networks, whatever the cause, and of course, events due to bad weather.
The conditions of transport and delivery will be sent by e-mail to the Customer at least one week before delivery.
Neither the Seller nor the carrier can be held responsible for an impossibility of delivery due to an inaccuracy in the delivery address.
The risks associated with transport (loss, damage or theft) are borne by the Seller, provided that the Customer has checked the goods on receipt in the presence of the carrier and has indicated the usual reservations on the transport note. In case of reservations upon receipt, these must also be reported to the Seller by e-mail or telephone within 48 hours of receipt of the package.
In case the goods are broken, the Customer must refuse the package. Only then can a new product be sent back to the customer. It is therefore imperative to check the contents of the package at the time of receipt, in the presence of the delivery person. Any such refusal must also be reported to the Seller by e-mail or telephone within 48 hours of the carrier's visit. Any parcel accepted by the Customer, but which proves to be broken, cannot be replaced by the Seller.
In the event of the return of a parcel not claimed by the addressee, the Seller undertakes to offer a second delivery subject to the Customer's contribution to the delivery costs.
VII - AFTER-SALES SERVICE AND COMPLAINTS
The Seller's after-sales service can be reached by e-mail at email@example.com.
All complaints regarding defects in the goods delivered, inaccuracies in quantities or references, must be addressed to the Seller by e-mail or telephone within 48 hours of receipt of the goods.
Any return of goods requires the prior agreement of the Seller, who may decide to provide a return voucher depending on the situation encountered. The return address will be provided to the Customer by e-mail. The packaging must be kept in perfect condition. If the package is lost or damaged when the product is returned, the cost of the damage is to be paid by the Customer.
If the item originally ordered is no longer available, the Customer may request an equivalent item or a full refund of the order.
It is reminded that the Seller is responsible in principle for everything concerning the safety of the products.
In any event, the Seller's liability shall not exceed the value of the item purchased and no other compensation may be claimed apart from those expressly provided for in the Consumer Code.
In the event that an order does not reach the Customer but a shipment has been made by the Seller with a parcel number, the Customer has 45 days to make a claim to the Seller. At the conclusion of the investigation, the Seller may decide to proceed with the partial or total refund of the order as soon as possible.
VIII- RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from his purchase without giving any reason within fourteen days of receiving his order. In order to exercise this right, the Customer must return the goods to the address provided by e-mail after the return request, within this fourteen-day period. The packaging must be kept in perfect condition. The refund will be made by bank transfer upon receipt of the returned goods. The transport costs are then borne by the Customer.
The Customer must enclose a copy of the invoice or any other element enabling the Order in question and its holder to be identified with his request for withdrawal.
Only the Customer identified as such to Greenzy may exercise this right, to the exclusion of any other person, and in particular the person to whom the delivery is addressed (for example in the case of a gift).
IX - Guarantees
The Products sold on the Website comply with the regulations in force in Belgium and the European Union and have performances compatible with non-professional uses.
The Products are automatically and without additional payment, independently of the right of withdrawal:
- the legal guarantee of conformity, for apparently defective, damaged or spoiled Products or Products that do not correspond to the order; and
- the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and making them unfit for use.
It is recalled that within the framework of the legal guarantee of conformity, the Customer benefits from a period of two years as from the delivery of the goods to act against Greenzy. The Customer may thus choose between repairing or replacing the Product ordered, subject to the cost conditions provided for, and is exempt from providing proof of the existence of the Product's lack of conformity during the twenty-four months following the delivery of the Product.
The Customer may decide to make use of the warranty against hidden defects in the Product; in this case, he/she may choose either to terminate the sale or to reduce the sale price.
In order to assert his/her rights, the Customer must inform Greenzy, in writing, of the non-conformity of the Products within a maximum period of 15 days from the delivery of the Products or from the discovery of the hidden defects within the above-mentioned periods and return the defective Products in the state in which they were received with all the elements (accessories, packaging, instructions, etc.).
Greenzy will refund, replace or repair Products or parts under warranty that are found to be non-conforming or defective.
The cost of postage will be reimbursed on the basis of the invoiced rate and the cost of return will be reimbursed on presentation of the receipts.
Refunds for Products deemed to be non-compliant or defective will be made as soon as possible and at the latest within 15 days of Greenzy's finding of the lack of compliance or hidden defect.
The refund will be made to the Customer's bank account.
Greenzy cannot be held responsible in the following cases:
- Non-compliance with the legislation of the country to which the products are delivered, which it is up to the Customer to check,
- In case of misuse, professional use, negligence or lack of maintenance by the Customer, as well as in case of normal wear and tear of the Product, accident or force majeure.
Greenzy's guarantee is, in any event, limited to the replacement or reimbursement of Products that do not conform or are affected by a defect.
X - JURISDICTION AND APPLICABLE LAW
Sales contracts are subject to Belgian law. Any dispute relating to sales with the Customer shall, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the Commercial Court of Brussels.
